Killer breaks probation back in slammer

JACKSONVILLE, Fla. 2014-01-04– A Jacksonville man who lost his father almost seven years ago in an automobile accident, has taken steps to put his father’s killer back in prison for probation violations.

Carl Harms lost his father James, a 24-year Navy veteran, in April of 2007 in a four vehicle crash on I-10 in Gulfport, Mississppi. He was on his way to see his daughter in Hammond, Louisiana.

The fatal accident was caused by 24-year-old Alicia Carmack. She was sentenced to 25 years for DUI causing a death, and leaving the scene of an accident.

A judge suspended 15 years of that sentence, and she served less than four years before getting out early in December 2012. Soon after that Harms looked her up on the internet, hoping to see her living a better life.

“I wanted to see that her life had changed, that my father’s life was worth something,” said Harms.

Harms says the conditions of her probation were not using alcohol, staying away from bars and not leaving her home county and Gulfport, Mississippi without permission. What he found on Facebook told a different story over a several month period. He found pictures of Carmack partying and drinking at various clubs, and postings of a trip with friends out of state to Baton Rouge, La.

“Every picture I found, did not want to see them, but every picture I found it was like getting that call all over again, like getting that call over  again, that he was killed. To see that she was disrespecting and dishonoring my father’s life, by taking a life and not owning up to it.”

Harms sent the photos to Mississippi authorities and several political leaders. Within two hours she was arrested, one year to the day after she got out of prison. Harms said in addition to disrespecting his father, she was disrespecting innocent lives in the community where she lived.

2014-01-04 —The Baton Rouge Police Dept has arrested Sherwood Taylor, 61, 42714 Yokum Rd, Ponchatoula, and charged him with 6th Offense DWI.

According to a report, Taylor was involved in “several motor vehicle accidents” in the 8800 block of Florida Blvd sometime around 5:45pm Friday night, January 3rd.

The investigating officer stated that upon contacting Taylor, he noticed Taylor had bloodshot eyes and was having trouble balancing. Taylor was given a standard field sobriety test which he performed poorly on.

Investigators took Taylor to a nearby police station, where he refused a breathalyzer test.

Taylor was taken into custody and charged with 6th Offense DWI, Driving Under Suspension and Reckless Operation. He was transported to EBR Parish Prison where he is currently awaiting bond.

DPS Police arrested a 26-year-old man early Sunday and charged him with 4th Offense DWI.

According to a report, officers came upon a vehicle being operated by Larry Woodard of Arcadia Louisiana, which was parked, running and had the lights on. The vehicle was located on 6th ave. in downtown Baton Rouge.

The report states that Woodard was asleep behind the wheel and the officer tried several times to wake him.

Once Woodard was awake and speaking to the investigating officer, the report notes that the officer detected a strong smell of an alcoholic beverage coming from Woodard.

Woodard told the officer that he was on his way home and that he had 6 12-oz beers prior to driving.

Woodard refused a standard field sobriety tests and was transported to the downtown DPS Police station, where he also refused to submit to a breathalyzer test.

He was charged with 4th Offense DWI and transported to EBR Parish Prison where he is currently being held on a $75,000 bond.

The following individuals were booked into the East Baton Rouge Parish Prison between December 30th, 2013 and January 5th, 2014 for driving while intoxicated.

Beck’s Snow Job Ends Life of Sign Post; Awarded DWI

2014-02-08 — New York State Police report that on February 5, 2014, at 8:30 am, Fredonia-based State Police were dispatched to an accident on State Route 20, in the Town of Pomfret. Upon arrival, the operator Robert K Beck III, age 49, from Dunkirk, NY, was found to be injured as well as intoxicated. Beck had been traveling east on State Route 20 when he struck a sign post on the south side of the road ending up in a snow embankment. EMS transported Beck to Brooks Memorial Hospital where he was treated and released. Beck was issued tickets for Driving While Intoxicated and Speed not Reasonable and Prudent returnable to the Town of Pomfet Court on February 18, 2014.

2014-02-08 –  On February 5, 2014 New York State Police report that a trooper  arrested Terri J Cartalano, 5,1 of Cattaraugus, NY for DWI when they stopped to check for a disabled vehicle on ST-62 in the Town of Leon.  Cartalano was transported to SP Jamestown where a BAC of .09 was obtained.  She was issued tickets for Driving While Intoxicated returnable to the Town of Leon Court and released.

2014-02-08 — New York State Police report that on February 4, 2014 at approximately 12 a.m., State Police in Ray Brook conducted a traffic stop on Bloomingdale Avenue, Saranac Lake on a 1999 red Chevrolet Cavalier.

The operator, 21-year-old Joshua J. Buchanen of Lake Placid, was subsequently arrested for driving while intoxicated.

His blood alcohol content was determined to be .15%. Buchanen was charged with Driving While Intoxicated (misdemeanor). He was also ticketed for inadequate headlight. He is scheduled to appear at the Town of Harrietstown Court on February 12, 2014 at 10 a.m.

2014-02-08 –  On February 4, 2014 at approximately 3:20 p.m., State Police in Potsdam responded to a report of a vehicle roll-over accident on State Route 11 in the Town of Potsdam.

20-year-old David W. Simmons of DeKalb Junction, had been operating a 2012 gray Chevrolet Impala on State Route 11 in Potsdam when he exited the north shoulder of the road, striking a snow bank. The vehicle then overturned onto it’s roof. Simmons was not injured.

Simmons was subsequently arrested for driving while intoxicated. His blood alcohol content was determined to be .27%, more than three times the legal limit. Simmons was charged with Aggravated Driving While Intoxicated for having a blood alcohol content of .18% or more. He was also ticketed for speed not reasonable.

He is to appear at the Town of Potsdam Court on February 13, 2014 at 9:30 a.m.

Speeding caught trooper’s attention to DWI driver

2014-02-08  – New York State Police report that on February 4, 2014 at approximately 8:47 p.m., State Police in Schroon Lake conducted a traffic stop on a 2009 Honda Accord, on I-87 in the Town of Schroon.

The operator, 61-year-old Scott R. Phillips of Landenberg, PA, was subsequently arrested for driving while intoxicated.

Phillips’ blood alcohol content was determined to be .14%.  Phillips was charged with Driving While Intoxicated (misdemeanor). He was further ticketed for speeding.

Phillips was arraigned at the Town of Schroon Court and was released under his own recognizance. He is to reappear in the Town of Schroon Court on February 10, 2014 at 11 a.m.

2014-02-08 —  (Afton, NY – January 31, 2014) On January 29, 2014, troopers at SP Sidney arrested Randy A. Leizear,  58, of Bainbridge, NY for driving while intoxicated with a reportable BAC result of .15%. The arrest resulted from a vehicle and traffic law stop for a turn signal violation on Maple Street in  Afton, NY.  The investigation determined that he was intoxicated while driving at that time.  Mr. Leizear was issued tickets returnable to the Village of Afton Court on February 3, 2014.

State Police conduct Underage Drinking Initiative in Oneida County

2014-02-08  — (Remsen, NY -) – On February 2, 2014, the New York State Police conducted an Underage Drinking Initiative compliance check of local establishments in Oneida County. As part of the initiative 17 establishments serving or selling alcohol within this area were checked for their compliance with the laws of the State of New York, relative to prohibiting sales of alcohol to persons under the age of twenty-one.  As a result of the operation the following was charged with one count of Unlawfully Dealing with a Child 1st degree and Prohibited Sale of an Alcoholic Beverage under the Alcohol Beverage Control law:

School Bus Driver Arrested for Aggravated Driving While Intoxicated

2014-02-08 — On February 3, 2014, the New York State Police from Williamson, NY, report that they arrested Julynn M. Criscuolo - dob 4/29/68, from Sodus, NY. Criscuolo was charged with:

Aggravated DWI – operating a school bus upon the public highway with a BAC of .18% or higher

DWI – operating a school bus upon the public highway with a BAC of .08% or higher

DWI – operating a school bus in an intoxicated condition

All of the above charges are felonies, and stem from an incident where Criscuolo was employed by the Wayne Central school district, and operated a bus while in an intoxicated condition on October 30, 2013.

Later that same day Criscuolo was involved in a serious personal injury MVA that occurred in the T/Macedon, and was arrested by the Macedon PD on 11/01/13.

Criscuolo was arraigned before Wayne County Court Judge Dennis Kehoe, and remains free on bail.

Schuyler County Man Arrested for Aggravated DWI

2014-02-08  – Jesse Mace, 52 of Alpine was arrested following a traffic stop in the village of Odessa.  Mace was charged with DWI and Aggravated DWI for having a BAC of .18% or higher.  He was issued Uniform Traffic Tickets returnable to the village of Odessa Court.
Canisteo Man Arrested for Felony DWI

2014-02-08 — The New York State Police report that a trooper arrested 45 year old Paul Banko of Canisteo and charged him with Felony DWI and Aggravated DWI for having a BAC of .18% or higher.  He was arraigned in the town of Hornellsville and released on his own recognizance to reappear at a later date.  Banko had a previous DWI conviction within the past 10 years making this charge a felony.

2014-02-11  —KTLA is reporting that the woman charged with DUI in the deaths of six people, Olivia Carolee Culbreath, had a prior DUI arrest and her sister, whom police say she killed in this horrible Sunday morning carnage had multiple DUI convictions. Her license had been suspended but had California court officials sent her to jail, she might still be alive. 

Four members of the same family were riding in the Explorer, according to the coroner’s office: Gregorio Mejia-Martinez and Leticia Ibarra, their daughter, Jessica Mejia, and Jessica’s grandmother, Ester Delgado.

Gregorio Mejia-Martinez and Ester Delgado died on scene, while Leticia Ibarra and Jessica Mejia died later at a hospital, the coroner’s office stated.

All four had apparently been ejected from the Explorer, according to a CHP statement that described the collision and information from the coroner’s office.

Culbreath was 17 when she convicted of a DUI in 2010 in San Bernardino juvenile court, the Los Angeles Times reported, citing DMV officials. She had at least two more traffic citations before her license was reinstated in December 2011, The Times reported.

Maya Culbreath also had multiple DUI convictions, and her license was suspended last year and had not been reinstated at the time of the crash, the newspaper reported.

Culbreath was arrested on suspicion of felony driving under the influence of alcohol causing great bodily injury or death, and of felony manslaughter, according to a news release issued by the CHP.  Read more:

2014-02-19 — POMONA >> The arraignment for suspected drunken-driving crash suspect Olivia Culbreath has been postponed because the Fontana woman remains hospitalized.

Olivia Carolee Culbreath, 21, of Fontana is still at Los Angeles County-USC Medical Center where her condition is unknown.

Los Angeles County sheriff’s booking records showed she was scheduled for a hearing in Pomona, but court officials on Tuesday said Culbreath hadn’t been brought to court and was not on the calendar.

No date has been scheduled for her arraignment.

D’IBERVILLE, Miss. 2014-02-19 - Todd Harrell, a founding member and bassist for 3 Doors Down who was already facing a vehicular homicide case in Tennessee, was arrested Tuesday night on a DUI charge in Mississippi, according to police.

Harrell was found “slumped over the steering wheel of his vehicle” by officers responding to a citizen’s call about an impaired driver, D’Iberville police Chief Wayne Payne told The Associated Press.

“On arrival our officers made contact with the driver and there were signs of his being impaired,” Payne said.

Harrell was charged with a second-offense DUI involving a substance other than alcohol, Payne said, and police got a court order to take a blood sample from him.

“We don’t know what the substance is at the time. We sent the sample on to the crime lab for testing,” Payne said.

Payne said Harrell was released on a $1,789 cash bond.

The DUI arrest is Harrell’s second in D’Iberville. In July 2012, his Cadillac rear-ended another vehicle. Harrell was later found to be driving under the influence of prescription drugs and was convicted. He lost his appeal in Harrison County Court on Jan. 8. In sentencing, the jail time was waived if Harrell could go six months without any further legal problems and enrolled in victim impact and substance abuse programs.

Harrell has also been in trouble in Nashville, Tenn. He’s accused of driving impaired in an accident resulting in another driver’s death in April 2013.

Baton Rouge Police have arrested 29-year-old Samuel Shavers, 1726 Northdale, Baton Rouge, after finding him passed out behind the wheel of his vehicle on Plank Rd. Thursday afternoon.

According to a report, an officer found Shavers behind the wheel of his vehicle, which was running and in ‘DRIVE’, in the 5900 block of Plank Rd. Shavers had his foot on the brake which was preventing the vehicle from moving forward.

The officer was unable to wake Shavers up so he had to break the window of his vehicle to remove Shavers from the car.

The report notes that Shavers appeared extremely intoxicated and had a very strong odor of alcohol emitting from him. There was also a cold, opened bottle of Olde English Malt Liquor in the console of the vehicle.

Shavers’ balance was so bad, he was unable to perform a standard field sobriety test. He also refused to submit to a chemical breath test.

An investigation revealed that Shavers was previously arrested for DWI on 7/25/09, 7/24/10 and 10/10/11.

Shavers was charged with 4th Offense DWI, Drinking in a Motor Vehicle, Obstruction of a Roadway, Operating While Under Suspension and Refusal to Submit to a Chemical Test.

He was transported to EBR Parish Prison where he is currently being held in lieu of a $53,500 bond.

2014-03-10 — During the early morning hours of Feb. 27, McDonald’s employees notified police about a suspected drunken driver.

The man they were concerned about had been released from the county jail hours before.

When police arrived to investigate, he tried to outrun them, making it a few blocks before colliding with another car, killing its driver, Cynthia Partida.

Police think the man, Christopher Cordil-Cortinas, was driving drunk – again.

A three-time convicted DWI offender, Cordil-Cortinas’ actions set off a debate about whether repeat DWI offenders should be dealt harsher punishments.

“I will tell you one of Mrs. Partida’s relatives called us for services, and I listened to his voicemail five times because I just couldn’t believe what I was hearing,” said Melissa Montgomery.

Montgomery is the manager of victim services for Mothers Against Drunk Driving in South Texas. She’d like to be out of the job, but in Texas, it isn’t until someone is convicted of driving while intoxicated a third time, a felony, that he or she  faces sanctions with real teeth, she said.

2014-03-12 — The Louisiana State Police arrested Shane Spillman, 40, of 44234 Calvin Templet Rd., St. Amant, on charges of DWI 2nd offense and improper lane usage on March 2nd, 2014 in Ascension Parish.

Spillman, the president of the Baton Rouge Fire Department Union, was released shortly after being booked into the Ascension Parish Prison. He posted a bond of $1169.50 + $177.00 for the 2 charges.

After Spillman bonded out of jail, Ascension Parish officials realized that he had an active warrant for failure to appear in court on a previous DWI he was arrested for, which occurred in 2009. The court date for that DWI arrest was in 2011 but Spillman failed to appear and a bench warrant for his arrest was issued.

Deputies, after realizing they missed the warrant while booking Spillman, went to his home and re-arrested him Tuesday.

He bonded out of the Ascension Parish Prison last night at around 8 p.m. after paying a $100 fee to reschedule the court appearance for his 2009 DWI arrest.

Baton Rouge Fire Chief Ed Smith told two Baton Rouge news outlets that he could not comment on the arrests because it is a personnel matter. He also stated that he could not comment on possible discipline because their investigation is not completed.

Spillman is a captain for the Baton Rouge Fire Department and works at Station 19 on Coursey Blvd.
