2013-10-28 — Three teenage children were left without parents when a driver, arrested on DUI and gross vehicular manslaughter charges, allegedly drove her car into them as the couple was out walking their dog, Menlo Park police said.

Cmdr. Dave Bertini said police took 54-year-old Marjorie Reitzell of Redwood City to the hospital after the Thursday evening crash, and added that she will be formally booked when she is released.

Sources tell NBC Bay Area that Reitzell was also convicted of misdemeanor drunk driving charges in San Mateo County in 2012.

Family members at the crash scene Friday — Chilco Street, west of Constitutional Drive — identified the deceased couple as Balbir Singh and Kamal Kaur, both in their 50s. Their children had called police when their parents didn’t come home. Police broke the news to them around midnight.

“They are all crying, they lost their father and mother,” Sarjeet Singh, the victims’ brother-in-law, told NBC Bay Area on Friday morning.

GRAND LAKE, Colo. (CBS4) 2013-10-31 – A family in Grand Lake is angry about a plea deal prosecutors offered an allegedly drunk driver who hit and killed a father of eight.

Gregory Westley died after being hit as he and his family walked on Highway 34 after a fireworks show. Four members of the family were also injured.

“It was murder,” said the victim’s mother Connie Westley. “Because the man did not use a knife or a gun but used a car, it should still be considered murder.”

Now prosecutors have offered a deal to the arrested driver, Lucas Ackerman. Police say he had a blood alcohol level of nearly twice the legal limit and he has a previous DUI.

Prosecutors offered Ackerman a plea deal that includes a year in prison, but the Westley family says that’s not an acceptable sentence for a repeat offender.

Officials with the Colorado State Patrol say Ackerman was driving 10 miles an hour below the speed limit and say the accident would have happened even if he hadn’t been drinking.

Connie Westley says the district attorney told her getting a conviction would be tough with that report. She disagrees.

“District attorneys should take a harder look at the plea bargains they offer to felons,” she said.

Grand County assistant district attorney Han Ng told CBS she knows Westley’s mother is hurting and she sympathizes, but she also said the office is not soft on crime. She says the plea bargain is a matter of justice.

But for the Westerly family, they feel betrayed.

“I resent the damage to his family who now has to live the rest of their lives without him,” his mother said. ….MORE

Las Vegas, Nevada — 2013-11-03 — A wreck last year that killed four people at a bus stop was a tragedy for all involved, including the driver, who was sentenced today to 24 to 80 years in prison, his lawyer said.

The sister of one of Gary Lee Hosey Jr.’s  victims agreed.

Jessica Amaya, sister of Gerber Ayala-Tomasino Jr., 24, told Hosey she asked to speak at his sentencing in Clark County District Court because she wanted Hosey to know her family understood he didn’t mean to kill her brother and they know Hosey was sorry. Amaya also said she understood Hosey’s family was suffering because of what happened.

“I’m sorry that this is happening to you,” Amaya said to Hosey, 25, about his sentence. “I’m sorry that my brother got lost.”

Still, Amaya said, even though a deadly crash wasn’t Hosey’s intention, intent didn’t change what happened — he could have chosen to take a taxi instead of getting behind the wheel.

Edward Kane, one of Hosey’s public defenders, said Hosey had written letters to the families of his four victims.

Hosey, who pleaded guilty Aug. 23 to five counts of driving under the influence and causing death or substantial physical harm, told the court he was remorseful and there wasn’t a lot he could say about what had happened.

“It was an accident,” Hosey said. “I am sorry for what I did. I didn’t mean to do that.”

Several members of the Hosey family also were present in the courtroom.

District Judge Jennifer Togliatti noted she had received a “volume of letters” speaking highly of Hosey from his family and friends.

Hosey’s sentence is one of the longer ones for DUI offenses, Deputy District Attorney Brian Rutledge said, noting prosecutors only agreed to a plea deal in the case because Hosey owned up to his actions and showed remorse.

Hosey lost control of his Chevrolet Monte Carlo on the morning of Sept. 13 and crashed into a bus stop at Spring Mountain Road east of Decatur Boulevard.

Four people waiting at the stop were killed: Ayala-Tomasino; Johnni Garner, 49; Margoth Gonzalez, 65; and Hyon Cooley, 47. Hosey, four passengers in his car and three other people at the bus stop also were injured. One of the injured people waiting at the bus stop was paralyzed and another suffered permanent ….MORE

BRIDGEVILLE, Del. -  2013-11-03 —State police say a Bridgeville man faces his 11th DUI charge following a traffic stop Saturday night.

According to state police, a trooper traveling south on Coverdale Road at 6:40 p.m. Saturday spotted the truck in front of him speeding and crossing into the northbound lanes numerous times.

The trooper activated the lights and siren on the patrol car, and the driver made a right onto Hastings farm Road and pulled into a private driveway.

State police say the driver, 77-year-old Ruppert Bell Jr., of Bridgeville, showed signs of impairment, and a DUI investigation ensued.

While he was in custody, a computer check revealed 10 prior DUI convictions dating back to 1987, and the most recent being in 2005.

Bell was arraigned on charges that including driving after judgment prohibited, driving while suspended or revoked, failure to remain in a single lane and speeding.

He was arraigned and sent to jail in lieu of $16,102 cash bond.

George Reaver was arrested for DWI by Maryland State Police Trooper Esposito on Oct. 3, 2013 at 10:50 pm while operating his 2006 Mazda westbound on Rt. 140 in Carroll County near Westminster.  He has a court date set for January but the terms of his probation on another DWI charge in 2012 could kick in and cause him to be incarcerated just before his important conference he has set up in early December.

Reaver is the director of Federal Government Receivables and Research Bureau, which hosts a series of conferences nationwide each year. The FGRRB conducts seminars on explaining to contractors, big and small, how to get their money out of Uncle Sam for their purchases.

While Reaver appears, from his website, to be a very accomplished credit manager and facilitator for government contractors frustrated with the Machiavellian habits of the federal pay system for vendors, his criminal driving record in the State of Maryland shows he is very dangerous.  Reaver likely is an un-recovering alcoholic who has a serious problem. His biggest problem is also that of the motoring public, whom the legal system has deemed appropriate to have to share the highways with Reaver. Simply put, he is allowed to drive in Maryland. If not grounded, whether in jail or having his license suspended, his record shows he will continue to operate a motor vehicle while impaired until he kills himself or someone else.

His most recent DWI arrest prior to this year, came on Feb. 26, 2012 at 1:55 am, about the time bars and taverns have their last call. He was stopped by Trooper Fike on Rt. 91 near Rt. 32 in Carroll County. He entered into a plea agreement with the Carroll County States Attorney’s Office on Jan. that ended with a Probation without Judgment. A PBJ typically requires the defendant to not commit a criminal offense, particularly the same one, within five years. As conditions of his plea agreement he was to be sentenced to the Carroll County Detention Center for 6 months but be on probation for five years with the first 2 years supervised by the drunk drivers monitoring program, abstain from alcohol with testing and evaluations to take place.

His OctoberFest DWI appears to be a trigger to send Reaver to the slammer but, this is Maryland, where in the land of Winkin’, Blinkin’ and Nod, anything can happen.

Why did his 2012 nearly send Reaver to jail? It wasn’t his first rodeo. On June 26, 2002 the disposition in the same county of Maryland for a DWI charge that year was also that he be given a PBJ with a suspended sentence. Given his continued use of alcohol as shown by his 2012 and 2013 arrests, Reaver likely didn’t quit boozing and cruising, he simply wasn’t caught.

Reaver was selected at random from the 461 persons charged in October with DWI for a background review and his driving record in other states was not explored, therefore it is entirely possible he has been arrested for DUI / DWI elsewhere, these arrests all occurred in Maryland.

George Reaver the Director of FGRRB has worked in the Credit and Collection industry over 20 years, starting his career in consumer and banking finance. As the Collections Manager for a multi- billion dollar major Baltimore Bank, George managed 4 departments and a staff of 32 employees.

In 1987 George changed the direction of his career and started working for a major beverage distributor as their Northeast Accounts Receivables Manager, and managing a staff of 40 billing and accounts receivables personnel. Mr. Reaver’s next step was to assume the role of the full Credit Manager for a national engineering and construction firm based in Baltimore, MD. As their Credit Manager, George’s roles now included Credit, Billing, Contracting, Cash Applications and Collections. The engineering company soon became a certified defense contractor and George became well educated and informed in Federal Government regulations.

At one point during this 10 year span, Mr. Reaver was asked by the Office of Management and Budget to testify in front of a Congressional Sub-committee as to the application of the Prompt Payment Act. Although Executive Management frowned upon such testimony, George was permitted to write a brief and submit it to the Office of Management and Budget.

With 15 years of Credit and Collections experience, 10 of those as a defense contractor, in 1999 George became the Director of Government Receivables for a trade association representing nearly 30,000 members.  In 2002 Mr. Reaver wishing to create a full service federal government member based organization created FGRRB.

A 29-year-old man with five previous DWI convictions was arrested after allegedly passing out while in a drive-thru at a fast-food restaurant early Sunday morning, El Paso police report.

Police responded to call at about 2:20 a.m. from a manager at the Whataburger along the 1100 block of Yarbrough that a driver had fallen asleep in a vehicle going through the drive-thru.

Officers found a man, later identified as Rodrigo Melendez of the 8800 block of Joe Kennedy, stopped and asleep inside an Infiniti G35.

Officers knocked on the vehicle window, and Melendez awoke and began to drive forward, police said. Police were able to get him to stop and they then observed several signs of intoxication, they reported.

They learned that Melendez had five previous DWI convictions – one in 2004, two in 2008 and two in 2009. ….MORE

2013-11-14 —- A man who pleaded guilty to vehicular homicide 10 years ago received a 90-day suspended sentence and a year probation for his latest drunken-driving charge.

Nick Mares, 33, received his sentence Oct. 15 in the Santa Fe Magistrate Court after pleading no contest to a misdemeanor DWI charge. As part of the plea deal, Mares also has to install an interlock intermission in his vehicle and attend a DWI compliance course. He also has to spend 24 hours volunteering at the Boys & Girls Clubs of Santa Fe.

He will pay $241 in fines, and Mares is not allowed to consume alcohol or enter “liquor establishments.”

SANTA FE – A Santa Fe man who killed his friend in a drunk driving crash apparently did not learn his lesson.

Nick Mares was arrested just after 1 a.m. Tuesday after backing his truck into a taxi in a parking lot off Cerrillos Road. He then got vocal with the taxi driver.

Officers say Mares refused to submit to a breathalyzer, but smelled of alcohol and was booked for DWI.

In September 2003, Mares crashed his truck in a field off Cerrillos. His passenger, Albertano C De Baca, was crushed by the vehicle and died.

A police reports shows Mares’ blood alcohol level was point .19, more than twice the legal limit.

He later pleaded guilty to vehicular homicide, but spent less than a year behind bars.

Why Is Drugged Driving Hazardous?

2013-12-04 —The effects of specific drugs of abuse differ depending on how they act in the brain, but all impair faculties necessary for the safe operation of a vehicle. These faculties include motor skills, balance and coordination, perception, attention, reaction time, and judgment. Even small amounts of some drugs can have a measurable effect on driving ability.

How Many People Take Drugs and Drive?

According to the 2012 National Survey on Drug Use and Health (NSDUH), an estimated 10.3 million people aged 12 or older (or 3.9 percent of adolescents and adults) reported driving under the influence of illicit drugs during the year prior to being surveyed. This was higher than the rate in 2011 (3.7percent) and lower than the rate in 2002 (4.7 percent). By comparison, in 2012, an estimated 29.1 million persons (11.2 percent) reported driving under the influence of alcohol at least once in the past year. (This percentage has dropped since 2002, when it was 14.2 percent.)

According to the National Highway Traffic Safety Administration’s (NHTSA) 2007 National Roadside Survey, more than 16 percent of weekend, nighttime drivers tested positive for illegal, prescription, or over-the-counter drugs. More than 11 percent tested positive for illicit drugs.

According to NSDUH data, men are more likely than women to drive under the influence of an illicit drug or alcohol. And young adults aged 18 to 25 are more likely to drive after taking drugs than other age groups.

How Often Does Drugged Driving Cause Accidents?

It is hard to measure the exact contribution of drug intoxication to driving accidents, because blood tests for drugs other than alcohol are inconsistently performed, and many drivers who cause accidents are found to have both drugs and alcohol in their system, making it hard to determine which substance had the greater effect.

2013-12-09 — A 45-year-old Wyoming man has been charged with Driving Under the Influence in a crash this weekend that took the life of a western Nebraska woman and left another with life-threatening injuries.

The Nebraska State Patrol reports Edward Hood was taken to the Garden County Jail after being treated at the Garden County Hospital for injuries suffered in the wreck.

According to NSP, Hood was driving eastbound on Highway 26 west of Oshkosh Saturday afternoon when he lost control of his car, crossed the center line of the highway, and struck a westbound car driven by 62-year-old Terry Hofer of Ogallala. 2013-12-16 —old woman dead, has been arrested for driving under the influence. The woman has been identified as Rockford resident Ashley Charles.

She was pronounced dead at a hospital. The driver, Dawon C. Keenan, was treated and released. Police took Keenan from the hospital to the Winnebago County Jail.

Keenan faces charges of reckless homicide, aggravated driving under the influence involving a death, driving under the influence with a blood alcohol content of higher than 8 percent, failure to reduce speed to avoid an accident and driving on a suspended license.

2013-12-25  — A Casper man arrested after a fatal head-on collision earlier this month appeared in Natrona County Circuit Court on Monday to face an additional charge: a fourth driving-under-the-influence offense, which is a felony.

Natrona County Assistant District Attorney Randall Carnahan said during the initial hearing that it’s likely Tracy Matekovic’s charge will be increased to vehicular manslaughter.

Prior to Monday, Matekovic had been charged with assault on a peace officer and breach of peace.

Authorities say Matekovic’s Silverado pickup truck collided with the 1998 Mustang driven by Christopher Sanders of on Dec. 9 along U.S. Highway 20/26 near Six Mile Road. Sanders died as a result of the accident.

Matekovic asked in court on Monday that his bail not be set at the recommended $25,000 so that he could work and provide for his family before a potential trial.

“I have a pregnant wife, two kids and I’m behind two months on my mortgage,” he said.

Natrona County Circuit Court Judge Michael Huber set bail at $25,000.

The DPS Police Department arrested 25-year-old Brian Hartwell, 12235 Wickwood Dr., Baton Rouge and charged him with 3rd Offense DWI.

According to a report, an officer witnessed Hartwell’s vehicle traveling at a high rate of speed and run through a red traffic light around 3:30am on the morning of Friday, December 20th.

The officer stopped Hartwell’s vehicle at which point Hartwell jumped out of the vehicle and approached the officer “in an aggressive manner.” Hartwell was immediately handcuffed, read his rights and placed in the rear of the officer’s vehicle.

The officer noted in the report that he detected an odor of alcohol omitting from Hartwell. When asked if he had anything to drink tonight, Hartwell replied “I only had 6 drinks tonight, my manager can verify that,” according to the report.

Hartwell was given the opportunity to perform a series of standard field sobriety tests. Hartwell replied telling the officer that he was “refusing everything, the test, the blow thing and all of your other bull shit.” Hartwell then used an expletive while speaking with the officer and suggested that the officer perform fellatio on him.

Hartwell was transported to the DPS Police Administration Building where he was combative, according to the report. He refused to sign any documentation and continually attempted to damage the chair he was sitting in. He continued suggesting that the officer perform fellatio on him and shouting other expletives. Hartwell broke the leg off of the chair after slamming it to the ground several times, according to the report. He also threatened officers on multiple occasions.

Officers charged Hartwell with 3rd Offense DWI, Disobeying a Red Light, Reckless Operation, Driving Under Suspension From a Previous Arrest, Resisting Arrest and Simple Criminal Damage to Property.

He was transported to the EBR Parish Prison for booking.

Fatality Crash East Tenth Street and Sycamore Avenue

The Sioux Falls Police report: On January 1, 2014, at 1:37 a.m., Sioux Falls Police, Sioux Falls Fire Rescue, and Rural Metro Ambulance were dispatched to the intersection of East Tenth Street and Sycamore Avenue for an injury accident.

The investigation showed that there was a two-vehicle crash causing one passenger in the vehicle that was struck to have life-threatening injuries. This Sioux Falls resident was transported to an area hospital, where the passenger succumbed to her injuries and was pronounced deceased.

Further investigation revealed that one vehicle was traveling southbound on Sycamore Avenue approaching East Tenth Street and had a flashing red traffic signal. The other vehicle was traveling westbound on East Tenth Street approaching Sycamore Avenue and had a flashing yellow light. The two vehicles collided in the intersection when the suspect’s vehicle failed to stop for the flashing red traffic signal.

The driver of this vehicle was uninjured and identified as 20-year-old Sioux Falls resident Oscar Madrigal. He was subsequently arrested for vehicular homicide, DWI second offense, no driver’s license, failure to obey a traffic control device, and an outstanding warrant. The other two occupants in the victim’s vehicle were treated for minor injuries and released. The name of the victim is being withheld at this time.
