CALCASIEU PARISH, LA — 2013-08-27 -Two men have been booked on fourth offense DWI for the second time, according to a news release from the Calcasieu Parish Sheriff’s Office.

David G. Prater, 58, of Westlake, and Michael P. Miller, 33, of Sulphur, are accused in separate cases.

Authorities said Prater, who has a prior vehicular homicide conviction, was arrested around 10 p.m. Friday following a traffic stop near the intersection of Davis Road and Goss Road in Westlake. A deputy spotted a pick-up truck swerving onto the shoulder and into the opposing lane of travel several times.

“When the deputy approached the truck and spoke with the driver, Prater, he detected a strong odor of alcohol emitting from his breath, along with slurred speech and he appeared very unsteady on his feet,” the release states.

Authorities said Prater refused to perform a standard field sobriety test and also refused to submit a breath intoxilyzer test.

Prater was convicted of vehicular homicide and DWI fourth offense in 2006.

He was booked into Calcasieu Correctional Center and charged with DWI fourth offense, careless operation and no driver’s license.

Bond was set at $252,000.

Authorities said Miller was arrested for the second time on a fourth offense DWI on Saturday.

KNOXVILLE — A 49-year-old Sevierville man with a history of DUI convictions faces an aggravated vehicular homicide charge in a fatal three-vehicle crash Friday on Gov. John Sevier Highway.

Scott C. Spangler also is charged in Knox County with possession of drug paraphernalia, vehicular assault and driving while his driving privilege had been revoked, warrants show.

Spangler, who has an extensive criminal record, is accused of driving into and killing motorist Benjamin Woodruff, 38, of Knoxville, who was stopped in a turn lane on the highway. The crash occurred about 6:20 p.m. near Austin Park Lane, according to the Tennessee Highway Patrol.

A Stafford man was arrested after police said he was driving drunk and caused a crash in the mid-county area.

Officers were called to the area of Hoadly and Purcell roads for a crash around 1:30 a.m. Tuesday, Prince William police spokesman Jonathan Perok said.

The driver of a 2007 Lincoln Navigator was headed northbound on Dale Boulevard when he “disregarded the red traffic signal” at the Hoadly Road intersection and collided with a 2002 Honda Accord which was going west on Hoadly Road, Perok said.

The Lincoln’s driver tried to leave, but police said the SUV “became inoperable” nearby.

Investigators determined the driver of the Lincoln, who was not hurt, was at fault for the crash, was driving under the influence of alcohol and was in possession of marijuana, Perok said.

The driver and passenger of the Honda were taken to the hospital for “significant but non-life threatening injuries,” according to Perok.

The Baton Rouge Police has arrested a 29-year-old man and charged him with 4th Offense DWI.

According to an affidavit, Brian Neely, 29, 202 E. Boyd, Baton Rouge, was stopped by an officer around 2:00 AM on September 18th after he was seen driving the wrong way on Bob Petit Blvd, which is a divided road.

When the officer made contact with Neely, he reportedly had slurred speech, red eyes,  a strong odor of alcohol and was swaying while standing up.

Neely was taken to the LSU Police Dept. for a chemical test, which he refused.

The investigating officer noted in the report that Neely had prior arrests for DWI in February of 2007, September of 2010 and

2013-09-27 — A bomb-maker who claimed, without much success, to be a passenger on his own Harley Davidson motorcycle during a drunken wreck four years ago that killed his girlfriend was sentenced Thursday to 45 years in prison.

Jurors found Donald Huff, 54, guilty in June of felony murder. He asked state District Judge Sid Harle to determine his sentence.

Huff was originally charged with intoxication manslaughter, which would have carried a maximum 20-year punishment, for the August 2009 wreck. Prosecutors enhanced the charge by alleging that he caused the death of Arlene Kay Harding-Watts, 46, in the course of committing another felony: a third driving while intoxicated arrest.

Since that wreck, Huff has been arrested a fourth time on a DWI charge, prosecutor David Henderson said Thursday as he sought a life sentence. Huff was also on federal probation for manufacturing an explosive device, he noted.

The defendant had agreed to make a pipe bomb for a methamphetamines cook in exchange for more drugs, not realizing at the time that the explosive was intended to be used for a (foiled) retribution plot, attorneys said. He was given probation after cooperating with federal authorities.

During a brief statement to the judge, Huff said Harding-Watts, whom he had met several months earlier while purchasing cigarettes, was an excellent driver and he enjoyed letting her take control.

“I am filled with remorse that I allowed Arlene to drive the motorcycle and that I rode with her after we had been drinking alcohol, resulting in her death,” he said in an affidavit filed by attorneys Ronald Guyer and Justin Fischer.

But EMS technician Kevin Norman, who testified during Huff’s jury trial that he was the first emergency responder to arrive on scene, cast doubt on the defendant’s contention he was merely a passenger.

“We saw him trying to pick her up and put her on the motorcycle,” Norman said of Huff, who was later found to have a blood

Gettysburg — 2013-09-28— An Adams County judge granted four preliminary objections to a Gettysburg social club being sued for punitive damages in a Dram Shop lawsuit.

The father of a Fairfield woman killed by a drunk driver last year filed a lawsuit in Adams County Court of Common Pleas against the Gettysburg Moose Lodge, alleging the club served the man alcohol while he was noticeably intoxicated.

In his Sept. 17 opinion, Adams County President Judge Michael George wrote that the driver’s prior DUI conviction – he was performing community service at the club the night of the fatal wreck – was not legally relevant to support a claim of punitive damages, but left the door open to other claims that could lead to punitive damages.

Angela Rigby, 33, was killed Sept. 14, 2012, while driving eastbound on Route 30 after she was hit head-on by a vehicle being driven by Brandon Zirk, 28, of Waynesboro. A blood test after the crash confirmed Zirk’s blood alcohol content was 0.18, more than twice the level at which drivers are presumed intoxicated in Pennsylvania. Zirk pleaded guilty to homicide by vehicle while under the influence and is serving a sentence of 3.5 to 10 years in prison.

William Rigby, Rigby’s father and the administrator of her estate, argued the Gettysburg Moose violated the Pennsylvania Liquor Code by serving Zirk alcohol while he was visibly intoxicated and that the club had a duty to monitor patrons being served alcohol. Zirk was at the Gettysburg Moose on the night of the wreck to perform community service for a 2011 DUI charge in Franklin County.

“The act does not place a heightened duty on an establishment based upon a customer’s known propensities,” George wrote.

A New Mexico motorist guilty of killing a motorcyclist in a 2006 drunk driving crash is accused of causing another fatal accident while driving under the influence.
In an apparently cruel coincidence, the Albuquerque Journal reported that the man Jacob Williams allegedly killed on Saturday was the brother of the judge who sentenced him for the first deadly wreck.
A witness twice called 911 about Williams; once for driving erratically in her neighborhood in Berlen, a town 30 miles south of Albuquerque and, hours later, for fighting with a neighbor.
Shortly after the second complaint, the 27-year-old suspect allegedly veered into oncoming traffic and crashed his pickup into a motorcycle carrying two people. The head-on collision killed 51-year-old Daniel Sanchez and caused serious leg injuries to his 11-year-old daughter Magan Sanchez.

Dover DE- The Delaware State Police have arrested a man from Camden after he was found to be operating a motor vehicle under the influence of alcohol for the 6th time.
The incident occurred at approximately 4:38 p.m. Friday afternoon when a trooper was dispatched to a report of a male passed out in the parking lot of Royal Farms located on the corner of West  Lebanon Road and South State Street.

The trooper was able to locate the vehicle in question still running and observe the driver, who was later identified as Titus W. Hobbs, with his foot on the brake.
Police say that Hobbs who was slumped over in the vehicle asleep, was woken by the trooper who could immediately smell alcohol being emitted from him.  A DUI investigation ensued and Hobbs was taken into custody and transported back to Troop 3. A computer check revealed he had five previous DUI convictions (10/09/89, 12/28/89, 12/31/89, 11/30/94, and 03/13/96); this arrest would make #6.
Titus Hobbs was arraigned on the Felony DUI charge and later released after posting $5,000.00 cash bond.

OGDEN, Utah —  2014-04-12– A 26-year-old woman accused of killing another driver in Ogden while her blood alcohol was more than four times the legal limit has been ordered to prison.

Chelsey Lauran Raffield was sentenced Thursday to one to 15 years behind bars after pleading guilty to automobile homicide.

Ogden police say Raffield was going about 80 mph in a 30 mph zone near Adams Avenue and 30th Street when she ran through a stop sign and hit another car.

The 22-year-old driver of that car, Elsa Alonso, was killed.

Raffield suffered a broken ankle and other minor injuries.

She had previously been convicted of a DUI in November 2011.

Beck’s Snow Job Ends Life of Sign Post; Awarded DWI

 

2014-02-08 — New York State Police report that on February 5, 2014, at 8:30 am, Fredonia-based State Police were dispatched to an accident on State Route 20, in the Town of Pomfret. Upon arrival, the operator Robert K Beck III, age 49, from Dunkirk, NY, was found to be injured as well as intoxicated. Beck had been traveling east on State Route 20 when he struck a sign post on the south side of the road ending up in a snow embankment. EMS transported Beck to Brooks Memorial Hospital where he was treated and released. Beck was issued tickets for Driving While Intoxicated and Speed not Reasonable and Prudent returnable to the Town of Pomfet Court on February 18, 2014.

2014-02-08 –  On February 5, 2014 New York State Police report that a trooper  arrested Terri J Cartalano, 5,1 of Cattaraugus, NY for DWI when they stopped to check for a disabled vehicle on ST-62 in the Town of Leon.  Cartalano was transported to SP Jamestown where a BAC of .09 was obtained.  She was issued tickets for Driving While Intoxicated returnable to the Town of Leon Court and released.

2014-02-08 — New York State Police report that on February 4, 2014 at approximately 12 a.m., State Police in Ray Brook conducted a traffic stop on Bloomingdale Avenue, Saranac Lake on a 1999 red Chevrolet Cavalier.

The operator, 21-year-old Joshua J. Buchanen of Lake Placid, was subsequently arrested for driving while intoxicated.

His blood alcohol content was determined to be .15%. Buchanen was charged with Driving While Intoxicated (misdemeanor). He was also ticketed for inadequate headlight. He is scheduled to appear at the Town of Harrietstown Court on February 12, 2014 at 10 a.m.

Man charged with driving his car on its roof after DWI flip-over

2014-02-08 –  On February 4, 2014 at approximately 3:20 p.m., State Police in Potsdam responded to a report of a vehicle roll-over accident on State Route 11 in the Town of Potsdam.

20-year-old David W. Simmons of DeKalb Junction, had been operating a 2012 gray Chevrolet Impala on State Route 11 in Potsdam when he exited the north shoulder of the road, striking a snow bank. The vehicle then overturned onto it’s roof. Simmons was not injured.

Simmons was subsequently arrested for driving while intoxicated. His blood alcohol content was determined to be .27%, more than three times the legal limit. Simmons was charged with Aggravated Driving While Intoxicated for having a blood alcohol content of .18% or more. He was also ticketed for speed not reasonable.

He is to appear at the Town of Potsdam Court on February 13, 2014 at 9:30 a.m.

Speeding caught trooper’s attention to DWI driver

2014-02-08  – New York State Police report that on February 4, 2014 at approximately 8:47 p.m., State Police in Schroon Lake conducted a traffic stop on a 2009 Honda Accord, on I-87 in the Town of Schroon.

The operator, 61-year-old Scott R. Phillips of Landenberg, PA, was subsequently arrested for driving while intoxicated.

Phillips’ blood alcohol content was determined to be .14%.  Phillips was charged with Driving While Intoxicated (misdemeanor). He was further ticketed for speeding.

Phillips was arraigned at the Town of Schroon Court and was released under his own recognizance. He is to reappear in the Town of Schroon Court on February 10, 2014 at 11 a.m.

2014-02-08 —  (Afton, NY – January 31, 2014) On January 29, 2014, troopers at SP Sidney arrested Randy A. Leizear,  58, of Bainbridge, NY for driving while intoxicated with a reportable BAC result of .15%. The arrest resulted from a vehicle and traffic law stop for a turn signal violation on Maple Street in  Afton, NY.  The investigation determined that he was intoxicated while driving at that time.  Mr. Leizear was issued tickets returnable to the Village of Afton Court on February 3, 2014.

2014-02-08  — (Remsen, NY -) – On February 2, 2014, the New York State Police conducted an Underage Drinking Initiative compliance check of local establishments in Oneida County. As part of the initiative 17 establishments serving or selling alcohol within this area were checked for their compliance with the laws of the State of New York, relative to prohibiting sales of alcohol to persons under the age of twenty-one.  As a result of the operation the following was charged with one count of Unlawfully Dealing with a Child 1st degree and Prohibited Sale of an Alcoholic Beverage under the Alcohol Beverage Control law:

School Bus Driver Arrested for Aggravated Driving While Intoxicated

2014-02-08 — On February 3, 2014, the New York State Police from Williamson, NY, report that they arrested Julynn M. Criscuolo - dob 4/29/68, from Sodus, NY. Criscuolo was charged with:

Aggravated DWI – operating a school bus upon the public highway with a BAC of .18% or higher

DWI – operating a school bus upon the public highway with a BAC of .08% or higher

DWI – operating a school bus in an intoxicated condition

All of the above charges are felonies, and stem from an incident where Criscuolo was employed by the Wayne Central school district, and operated a bus while in an intoxicated condition on October 30, 2013.

Later that same day Criscuolo was involved in a serious personal injury MVA that occurred in the T/Macedon, and was arrested by the Macedon PD on 11/01/13.

Criscuolo was arraigned before Wayne County Court Judge Dennis Kehoe, and remains free on bail.

Schuyler County Man Arrested for Aggravated DWI

2014-02-08  – Jesse Mace, 52 of Alpine was arrested following a traffic stop in the village of Odessa.  Mace was charged with DWI and Aggravated DWI for having a BAC of .18% or higher.  He was issued Uniform Traffic Tickets returnable to the village of Odessa Court.
Canisteo Man Arrested for Felony DWI

2014-02-08 — The New York State Police report that a trooper arrested 45 year old Paul Banko of Canisteo and charged him with Felony DWI and Aggravated DWI for having a BAC of .18% or higher.  He was arraigned in the town of Hornellsville and released on his own recognizance to reappear at a later date.  Banko had a previous DWI conviction within the past 10 years making this charge a felony.

SALISBURY, Md. —  2014-04-12— The owner and operator of Dayton’s Restaurant in Salisbury pleaded guilty to driving while impaired by alcohol in Wicomico County Circuit Court Friday.

Gordon Melvin Weitzel Jr., 58, of Salisbury had the remaining charges against him dismissed. The charges dated back to an Oct. 5, 2013, incident.

Judge W. Newton Jackson III sentenced Weitzel to serve 60 days in the form of 30 consecutive weekends in a weekend community service program through the Wicomico County Detention Center, beginning April 19. ….MORE

COLUMBUS, GA (Nov. 18, 2012) – A small purple cross now sits next to the crash site off County Line Road in Columbus where 16-year-old Hannah Gilmer lost her life.
Police say Clayton Qualls, 17, was under the influence of alcohol when he lost control of his girlfriend’s 2006 Toyota Scion. He is now facing several charges, including vehicular homicide.
After Qualls’ first court appearance was Monday, News Leader 9 learned this is not the first time the Qualls has been charged for driving under the influence.
Less than two weeks before the accident that claimed the life of Gilmer, reports show Qualls was pulled over in Harris County for DUI under 21. In that report, the deputy states, Qualls tested positive for alcohol after pulling over the teenage driver just off Winfree Road and Highway 208 in Harris County ….MORE

WELLINGTON, Fla. — 2014-04-12 — A Wellington man was arrested Friday on charges of driving drunk and crashing into an off-duty Boynton Beach police officer’s SUV.
Palm Beach County Sheriff’s Office says Jakub Gryczan, 32, of 4702 S. Fountain Drive in Wellington, was behind the wheel of a car that smashed into 26-year-old Richard Webster’s SUV on Feb. 21.
Gryczan was jailed Friday on a charge of DUI with seriously bodily injury and reckless driving. West Palm Beach police arrested him on a separate DUI charge on April 3.
PBSO reported at the time that Gryczan was driving a 2012 Volkswagen Passat “at a very high rate of speed” westbound on Southern Boulevard, approaching the Haverhill Road overpass at about 3:18 a.m. Feb. 21….MORE
