Delaware: Lenient liberal Judges Keep Highways Littered with Repeat Offender DWI Drivers: Gavin Coates Now Up to Third DWI
According to Rehoboth Beach Police Lt. Jaime Riddle,Gavin A. Coates, 48, of Oxford, Pa. was arrested Friday (09/14/18) evening for a third offense of driving a vehicle under the influence of alcohol after committing a traffic violation on Rehoboth Avenue.
Just after 9:00 pm a Rehoboth Beach Police officer observed Coates, who was operating a silver Toyota Camry, making an illegal turn at the intersection of Rehoboth Avenue and Second Street. The officer stopped Coates and upon making contact with him observed signs of intoxication. Coates was administered standardized field sobriety test and subsequently taken into custody for driving under the influence of alcohol.
Coates was transported back to the Rehoboth Beach Police Department for further testing at which time officers determined that Coates had prior DUI related convictions.
Coates was arrested and charged with 1 count of felony third-offense driving a vehicle under the influence of alcohol and 1 count of failure to obey a traffic control device.
Coates was committed to Sussex Correctional Institution in default of $2100.00 secured bail.

THE DEAL: in return for pleading guilty, Nolan was sentenced to 60 days in jail with all but 58 days suspended and zero fine. Mississippi: Driver Shelley Rose that was wrong way on I-59 and killed two others and herself in crash racked up fourth DUI in a few days prior to Thanksgiving Day mayhem

Shelley Rose was arrested Nov. 20, 2018, by the Lauderdale County Sheriff’s Department for her fourth offense felony DUI. She was released from the county detention center on a $10,000 bond about eight hours later.
Lauderdale County Chief Deputy Ward Calhoun said deputies arrested the 48-year-old Rose after the department received calls about the possibly intoxicated driver of a Dodge Caravan. Witnesses said Rose allegedly drove off the roadway and sideswiped a concrete parking barrier.
After she bailed out of the Lauderdale Detention Center, records show the Ellisville Police Department in Jones County arrested Rose the next day, on Nov. 21, on a public drunkenness charge. Ellisville is about an hour south of Meridian on I-59.
Rose was released without bail later that night, according to the Jones County Sheriff’s Department website.
Less than two days later, Rose was heading north on I-59 when her Dodge Caravan collided head-on into Bright’s Saturn Ion and Vincent’s Nissan Altima. A southbound Honda CRV then crashed into the Saturn and rolled over into the wood line, according to the Mississippi Highway Patrol. The agency is investigating the crash.
Turnage, who was preparing Thanksgiving dinner when he was called to the crash scene, said several witnesses who saw Rose driving the wrong way called 911, hoping to prevent an accident. But it was too late.
In Mississippi, a third DUI is a felony for anyone with two convictions if the first two DUI charges occurred within the previous five years. A third offense carries a sentence of one to five years.
Last year, the law changed to make a fourth offense, no matter the time period involved, a felony punishable by a minimum prison sentence of two years, with a maximum of 10.
Still, some in law enforcement say their hands are tied by the slowness of the court system in putting these cases together. And getting information from jurisdictions where previous DUI offenses have occurred is still a challenge, Lauderdale County Sheriff Billie Sollie said.
“In these cases, there’s a lot of post-incident reports to be conducted. Part of the problem is getting these cases for the prosecution. There can be multiple counties and jurisdictions involved and it’s not easy getting that information through the courts,” he said. MORE

Edward Sible Jr. entered a guilty plea to conspiracy to commit armed robbery, reckless endangerment, first-degree assault, and possession of a handgun, and attempted second-degree murder on Jan. 29, 1998. He was found not guilty of attempted armed carjacking. Sible was sentenced in Carroll County Circuit Court to 17 years in prison with credit for 412 days of time served while awaiting trial.

Sible pleaded guilty to conspiring with three friends to rob Linda D. Bond, 47, a Pizza Hut delivery woman who was shot during an ambush in February of 1997. In his statement of facts, prosecutor Clarence W. Beall III said Leo Joseph “Joey” Brandenburg Jr., and three friends — Edward F. “Eddie” Sible, 18, of Harney and Corey A. Coils, 19, and Melissa A. Redding, 18, both of Taneytown — agreed to call in an order to the Taneytown restaurant Feb. 20.
They planned the robbery because Sible did not have enough money to go to the movies, Beall said.
After luring the delivery woman to a remote area along Roop Road about 9 p.m., the plan went awry when she did not stop her car but continued driving after three shots from a .22-caliber pistol were fired at her car, he said.
One of the bullets shattered the windshield, Beall said. Another struck Bond in the shoulder. That bullet lodged behind her liver, where it remains and causes chronic pain, he said.
Despite her injuries, Bond drove back to Taneytown, where co-workers called for help and a state police Medevac helicopter transported her to Maryland Shock Trauma Center in Baltimore.
Sible, who police believe fired the shots, also has been charged with attempted first-degree murder and attempted carjacking, court records show.
(While Sible was awaiting trial in the Carroll County jail, he assaulted a Sheriff Deputy and earned an extra year in prison, according to Maryland Court records.)

In a plea deal with the Caroline County States Attorney and his attorney, Keith Jerome Gross, of Annapolis, the felony drug dealing charge was dropped and Saffran entered a guilty plea to misdemeanor possession. Saffran worked out a plea deal to another drug possession charge in Baltimore City Circuit Court on Dec. 5, 2017, when he pleaded guilty to possession and was given a verdict of Probation Before Judgment and on July 26, 2018, he was found guilty of violating his probation.

Another Failure of Delaware’s Judges to protect the public; James Betts charged with 4th DUI after sending four people to the trauma unit following a head-on crash

SEAFORD, DEL.– There is little doubt that the lenient Judges in Delaware are more concerned about the excuses and whines of drunk and drugged drivers than they are about the bleeding and dying of the general public.
The Delaware State Police have arrested a Seaford man for his 4th offense DUI and multiple counts of Vehicular Assault after he was involved in a crash.
Police say that James E. Betts, 50, of Seaford, Delaware, has now been charged following his stay at a hospital.
The crash that injured Betts and his three victims in another vehicle occurred on November 20, 2018, at approximately 9:05 p.m. when Troopers were dispatched to a crash at the intersection of Stein Highway and Neals School Road involving two vehicles.
Police say that a Subaru Forester was traveling eastbound on Stein Highway and entered into the westbound lane striking a Ford Explorer nearly head-on.
Betts was the operator of the Forester and was transported to the Nanticoke Memorial Hospital with serious injuries. Troopers located drug paraphernalia inside of the vehicle.
The operator of the Explorer, a 28-year-old male from Maryland and his 27-year-old female passenger sustained injuries and were transported to the Nanticoke Memorial Hospital. Two children ages 7 and 5, who were seated in the rear of the vehicle sustained major injuries and were also transported to the Nanticoke Memorial Hospital. The 7-year-old was later transferred to the A.I. DuPont Hospital.
Police say that a computer check revealed that Betts had three previous DUI arrests making this his fourth offense. On November 30, 2018, Betts was charged with the following:

Betts was arraigned before the Justice of the Peace Court 2 and committed to the Sussex Correctional Institution on $13,001.00 secured bond.
BETTS GUILTY IN MARYLAND DWI ARREST
On Nov. 2, 1998, James E. Betts pleaded guilty to possession of drugs in a plea deal with the Dorchester County States Attorney in District Court in Salisbury, Md. Betts was arrested by Natural Resources Police Officer J. Massey on June 24, 1998. THE DEAL: twenty days in jail was suspended, he was put on probation, violated his probation and was jailed on Sept. 21, 2000.
James Edward Betts Jr., of 9891 Middleford Road, Seaford, Del., was arrested on Nov. 13, 1999, for DWI – alcohol or drugs and entered a guilty plea on April 2, 2001, in a plea deal with Wicomico County States Attorney Davis R. Ruark. THE DEAL: 30 days in jail and one year of probation.
Several years later, Ruark, the prosecutor who let Betts slide with an easy plea deal, was himself arrested for DUI in Ocean City, Md. Wicomico County States Attorney Davis Ruark appeared in Ocean City District Court for trial stemming from his February 22, 2008, DUI arrest.
As the result of a plea agreement with Special Prosecutor Thomas M. Degonia, Ruark pleads guilty to DUI. In exchange for the guilty plea, the charges for handgun violation were dropped.
Retired District Court Judge John Coolahan (Baltimore County) accepted the conditions of the plea agreement and found Ruark Guilty of DUI.
Ruark was fined $500.00 plus court costs and put on unsupervised probation for one year. Ruark surrendered his handgun carry permit and was later allowed to have it reinstated. Ruark was defeated for reelection in the 2010 Democratic Primary and in 2012 moved to New Mexico where he works as a prosecutor.

Oregon State Police report that on Monday, November 26, 2018, at approximately 7:27 A.M. Oregon State Police and emergency personnel responded to the report of a hit and run crash on Hwy 99E at the intersection of Howell Prairie Rd.
The investigation revealed that a Chrysler PT Cruiser, operated by Luis Herrera Alvarez (41) was traveling northbound on Hwy 99E when he struck a Subaru Impreza, operated by Tatiana Reutov-Skorohodoff (23) of Salem, that was stopped on Howell Prairie Rd. waiting to turn southbound onto Hwy 99E. The Subaru Impreza was then pushed into a Chevrolet Malibu, operated by Jasmin Cortes-Garcia (23) of Mt. Angel, that was also stopped on Howell Prairie Rd. waiting to turn northbound onto Hwy 99E.
Herrera Alvarez fled the scene on foot and was later located on Boones Ferry Rd. He was arrested and lodged at the Marion County Jail on charges of DUII (.17 BAC), Reckless Driving, and Felony Hit and Run.
One of the passengers in the Subaru Impreza, Vaselisa Reutov (77), was transported to the hospital where she later died from injuries sustained in the crash.
This case has been referred to the Marion County District Attorney’s office for consideration of additional charges against Herrera Alvarez.
CALIFORNIA: Angela Fife wouldn’t freeze to death if she was walking across the North Pole in a bikini – she was 5 times legal limit when busted for DUI by Lakeport Police

LAKEPORT, CALIF. – A wild driver was arrested for DUI On December 4th at approximately 5:15 PM an off-duty Lakeport Police Department (LPD) Officer was driving a personal vehicle on Lakeshore Blvd. in the 2000 Block. The Officer saw a silver Chevrolet Impala driving south on Lakeshore Blvd and noticed it was weaving and in the bicycle lane and on the roadway shoulder. The Officer then saw the vehicle go into the opposite lane head-on toward another vehicle.
Not being able to stop the Impala, the Officer called in the vehicle and requested assistance for a drunk driver stop. While waiting for other LPD Officers, the off-duty Officer continued to follow the Impala and make observations. The Impala continued to travel dangerously and in the area of South Main Street and Lupoyoma Ave., it went through a crosswalk with a Pedestrian trying to cross.
On-duty Officers were responding in an emergency manner in order to get into position to stop the Impala and were able to stop it in the 300 Block of Lakeport Blvd.
DRIVER WAS NEARLY PICKLED!
The driver and sole occupant was identified as 44-year-old Lakeport resident Angela Fife. Officers determined that Fife was in fact intoxicated with a blood alcohol level of .40% which is 5 times .08% which is the limit where a person is presumed to be intoxicated while driving in California.
Because of her high blood alcohol content, Fife had to be taken to a local hospital for medical clearance before she could be booked into the jail.
After clearance, Fife was transported to the Lake County Jail and booked for driving under the influence, driving with .08% or more alcohol in the blood, driving with alcohol in the blood while on probation for driving under the influence of alcohol, driving with a drivers license suspended for a previous driving under the influence arrest, for having a third driving under the influence arrest within the past 10 years, for driving a vehicle not equipped with an ignition interlock device as previously ordered by a court to ensure she did not drive while under the influence and for an outstanding warrant from Sonoma County for driving with a license suspended for driving under the influence.
Lakeport California Police Chief Brad Rasmussen notes that two DUI drivers have crashed in Lakeport in the past week and urges drivers to make better decisions.
Posting on Facebook, Chief Brad Rasmussen said, “We appreciate our Officers work to remove as many intoxicated drivers as we can from our roadways and are glad this driver was not able to hurt or kill someone.”
Chief Brad Rasmussen said, “During the Thanksgiving, Christmas and New Year season we tend to see increases in drunk driving and will be increasing our efforts to arrest these persons. We ask for the public’s assistance in being alert for drunk drivers and calling 911 to report them when observed.”

LA QUINTA, CALIF. – According to Sergeant David Smith, of the Riverside County Sheriff’s Department, on Friday, January 25, at approximately 11:13 PM, officers from the La Quinta Police Department’s Special Enforcement Team (SET) attempted to stop a vehicle in the area of Washington St. and Highway 111. The vehicle failed to stop for the officers and a vehicle pursuit was initiated.

The suspect fled through the La Quinta Cove and into the City of Coachella where the driver, Christian Leon, 24 years old of Coachella, was taken into custody. There were no injuries sustained by law enforcement personnel or the public, and there are no outstanding suspects.

Jasmine Dorsey, 23 of Cathedral City, was driving under the influence of alcohol, say Palm Desert Police.
According to Sergeant Joe Ruiz of the Riverside County Sheriff’s Department, on January 26, 2019, ay 3:27 am. Officers from the Palm Desert Police Department responded to a single vehicle collision in the area of Hwy 111 and Parkview Drive in Palm Desert. Officers arrived on scene and located a Jeep facing traffic in the east bound lanes of Hwy 111. The vehicle initially collided into a center median and continued west striking a tree. The investigation revealed, Jasmine Dorsey, age 23 of Cathedral City, was driving under the influence of alcohol. After being medically cleared at a local hospital, Dorsey was booked into the Riverside County Jail located in the city of Indio for driving under the influence alcohol.

Marie Diekman, 30, of Palm Desert, DUI Jan. 28, 2019, La Quinta Police
On January 28, 2019, at 1:26 AM, La Quinta Officers responded to Avenue 48 and Washington Street, in the city of La Quinta, regarding a single vehicle, non-injury traffic collision. It was determined Marie Diekman, 30-years-old of Palm Desert, was driving a white 2011 Mercedes C 300 westbound on Avenue 48 when she failed to negotiate the turn onto Washington Street, and collided with a curb, a wooden post, and wire barrier. Diekman displayed obvious signs of intoxication and was arrested for driving under the influence of alcohol. Diekman was transported to a local hospital as a precaution and was booked into the Riverside County jail in Indio.

Jhonatan Urbina, 40 years of Indio, DUI on Jan. 23, 2019 by Palm Desert Police
On Wednesday, January 23, 2019, at approximately 8:30 AM, officers from the Palm Desert Police Department responded to a single vehicle traffic collision in the 73-000 block of Ironwood St., Palm Desert. It was determined the driver,Jhonatan Urbina, 40 years of Indio, was travelling eastbound on Ironwood St. and collided with a block wall on the corner with Burroweed Ln. Urbina did not sustain any injuries as a result of the collision, but during the investigation it was determined that Urbina showed symptoms of being under the influence of alcohol and/or drugs. Urbina was arrested for driving under the influence and was transported to a local hospital as a precaution. Once treated, he was booked into the Riverside County Jail in Indio.

John Foster, 63, of Wyoming, Calif. on Jan. 11, 2019 by Palm Desert Police
Police say that on January 11, 2019, 9:44 pm, officers from the Palm Desert Police Department responded to a reported traffic collision in the 43000 block of Warner Trail, within the city of Palm Desert. Officers determined a black Kia sedan traveling southbound on Warner Trail collided with a parked vehicle at the location. The driver of the Kia, John Foster, age 63 of Wyoming, was found to have been operating a motor vehicle under the influence of alcohol. After being medically cleared at a local hospital, John Foster was booked into the Riverside County Jail in Indio for driving under the influence of alcohol.

PHOENIX— According to the Maricopa County District Attorney’s Office, Jesus Ceja (D.O.B. 10-24-1962) was sentenced on January 9, 2019, to six years in the Department of Corrections after pleading guilty to Aggravated Driving While Under the Influence. This is the first time a case was prosecuted under HB2243, the Arizona law that charges an impaired wrong-way driver on the highway with a felony.

“This defendant was given the maximum sentence for his dangerous actions and his sentence will ensure that he will not pose a threat on our roadways to anyone for anytime soon,” said Maricopa County Attorney Bill Montgomery.
Prosecutors recited the facts of the arrest: on August 3, 2018 police received a 911 call about a man driving the wrong way in the westbound lanes of the US 60 near Crismon Road and almost colliding with another car. Officers attempted to get the driver, later identified as Jesus Ceja, to stop by blocking his vehicle’s path. However, after stopping the defendant attempted to back up and keep driving and officers had to command him to stop.
When interviewed Ceja admitted to drinking four beers but said that was not too much. He was found to have a blood alcohol content of more than twice the limit.
This is Ceja’s fifth conviction for driving under the influence.

The solicitor’s office said one of those charges will be upgraded to felony DUI death, after Ethan Frank Rubenzer of Boiling Springs died Sunday afternoon at Spartanburg Medical Center.
Lance Cpl. Joe Hovis with the S.C. Highway Patrol said Kelley was headed south on Boiling Springs Road (also Highway 9) when Kelley’s SUV hit a car turning left onto Boiling Springs Road from Birds Eye View.

Ethan was born on a very cold day (-22°), February 15, 2007, in West Allis, WI. He enjoyed Boy Scouts, fishing, camping, playing video games, Dungeons and Dragons, and sharing his gift of kindness with the world.
In addition to his parents, he is survived by his sister, Grace; maternal grandmother, Louise Gordon of Libertyville, IL; paternal grandparents, Patrick and Karla Rubenzer of Chippewa Falls, WI; his uncle, Peter Gordon of Lake Forest, IL; two cousins, Logen and Quinn Gordon of Wadsworth, IL; his Godparents, Greg and Amy Stilling of Libertyville, IL; special friends, Molly and Jake Stilling, the Kallieris family of Libertyville, IL, Christine and Emily Poplawski; and most of all, his best friends, Will Poplawski and Michaela Bryans.
Ethan was predeceased by his maternal grandfather, Joseph Gordon.
The family will greet friends Wednesday, February 13th, 3-6PM at Joy Lutheran Church in Moore, South Carolina. A memorial service will follow at 6PM.
In lieu of flowers, memorials may be made to Joy Lutheran Church, 3980 Moore-Duncan Highway, Moore, SC 29369 for the Carpenter’s Table Food Pantry, where Ethan loved to volunteer.
Additionally, Ethan has always wanted to be an organ donor like his grandma, Karla, and now his spirit and personality will live on in the recipients of his gifts.

“Devastatingly troubling.”
That’s how Delaware County District Attorney Katayoun Copeland described the circumstances surrounding the fatal crash that took the life of a 45-year-old Brookhaven woman in Upper Chichester Saturday night.
We could add a few others.
Senseless. And criminal.
David Matthew Strowhouer, a 30-year-old man from the Newtown Square section of Willistown Township, now faces charges in connection with the Saturday night fatal crash on Market Street in Upper Chichester Township.
Police now allege Strowhouer was under the influence of alcohol when he veered into the oncoming lane and slammed head-on into another vehicle. It would not be the first time.
In fact, this would be the sixth time Strowhouer would face charges of driving under the influence in a string of arrests in both Chester and Delaware counties.
Only this time it turned deadly. Police say Strowhouer’s SUV veered into the oncoming lane and slammed into another car. Denna Eckman was killed. Her husband Chris Eckman was seriously injured.
Police say Strowhouer was driving with a suspended license, the result of one of his previous DUI arrests.
He had done prison time on at least one of his previous DUI arrests in Delaware County, serving a one-to-five-year sentence in 2017. He was on parole at the time of Saturday night’s accident.
That will come as little comfort to the family of Eckman. That will give them something in common with the Hannagan family of Chester County, who lobbied for tougher sentences for drivers convicted of multiple DUI offenses. Their son and daughter were killed when their vehicle was struck by a drunken driver.

The truth is there is little the state or law enforcement can do if someone decides they are going to get behind the wheel. Suspending a person’s license does not prevent them from driving, regardless of whether they are impaired.
But they can’t drive from prison.
And that finally may be the way David Matthew Strowhouer is removed from the road.
That’s because state law has changed, and provides much stiffer sentences for drivers who rack up multiple DUI offenses.
The legislation, championed by former state Sen. John Rafferty, R-44 of Montgomery County, and Sen. Scott Martin, R-13 of Lancaster County, took the three-year mandatory sentence for a person convicted in a fatal DUI accident from three years to five years. A person with multiple DUI offenses, as Strowhouer does, would face up to seven years in prison. MORE

Chester County man faces sixth DUI – as well as homicide charge – for fatal crash in Delco
FROM THE PHILLYVOICE.COM – Chester County man faces multiple criminal charges in the aftermath of a fatal hit-and-run crash last weekend in Upper Chichester, Delaware County, prosecutors said.
The defendant, 30-year-old David Strowhouer, of Willistown, Chester County, allegedly was drunk at the time of the crash on Feb. 16. Strowhouer has five prior DUI convictions.
Police responded to the crash around 9:20 p.m. in the 3300 block of Market Street, where they found a Subaru WRX with a male and unresponsive female passenger trapped inside. A Dodge Ram pickup truck with severe damage was also found at the scene.
Investigators say they determined that Strowhouer, allegedly driving the pickup, crossed over the double yellow line and struck the Subaru. He then allegedly fled on foot.
Strowhouer had attended his mother’s funeral earlier that day and allegedly had been drinking alcohol, police said. When he returned to the crash scene, he allegedly told police that his cousin from Puerto Rico had been driving the car and that the two men were on the way to buy cocaine at the time of the crash.
Authorities say they believe that Strowhouer was lying about his cousin driving the pickup truck.
The male passenger in the Subaru survived the crash and was hospitalized with serious injuries. His wife died of her injuries, police said.
“I find this case to be devastatingly troubling,” District Attorney Katayoun Copeland said. “On a day where the defendant should have been with his family mourning the passing of his mother, he instead brought tragedy to another family.” MORE
