New York: Queensbury Councilman Timothy Brewer will face charges for 2nd arrest on DWAI-drugs; why does this guy drive while on autol-morphine drip?
From PostStar.com
GLENS FALLS — A Glens Falls city judge has upheld the driving under the influence of drugs charge against a Queensbury town councilman, setting the stage for a trial in the case next month.
Glens Falls Judge Richard Tarantino denied a motion to dismiss the misdemeanor charge of driving while ability impaired by drugs against 4th Ward Councilman Timothy Brewer. He was arrested last April after drivers who saw him driving erratically on Upper Sherman Avenue in Queensbury boxed his vehicle in and called police.
It was his second arrest for DWAI-drugs in a little over two years, stemming from prescription medications he has taken for back injuries. The first arrest, in January 2010, came after he drove into a log truck.
Brewer’s lawyer, Jeffrey Matte, had asked the judge to throw out the charge “in the interest of justice” and because of insufficient evidence. He argued that the medications, including morphine, were administered by a computer-controlled pain medication pump that Brewer had no control over, and they could have been injected after he was stopped.
Tarantino wrote that there “was potential ….MORE

Killer on the way to spending 15 to life behind bars…instead of in bars
From Valley News
RIVERSIDE – A repeat DUI offender whose SUV plowed into a car that immediately caught fire, killing a 43-year-old Perris woman at the wheel, was convicted today of second-degree murder.
Juan Antonio Covarrubias of Anaheim faces 15 years to life in prison when sentenced May 8 by Riverside County Superior Court Judge Richard Fields.
Jurors deliberated two hours before finding Covarrubias guilty of the March 31, 2012, death of Gyla Walters.
Riverside County Deputy District Attorney Amy Barajas said Covarrubias flagrantly disobeyed the law and violated the terms of probation from his earlier DUI conviction by binge drinking and then driving more than 50 miles on the morning of the wreck.
“The defendant had a record of DUI offenses, all of which he pled guilty to,” Barajas said. “Every time he pled guilty, he was warned of the dangers of drinking and driving. Yet he still made selfish choices that ended this woman’s life.”
The prosecutor said Covarrubias consumed beer for several hours with friends in Anaheim, then headed to a house party in Perris, staying until nearly dawn the following day.
“People told him not to drive home, but he didn’t care,” Barajas said…..MORE

Washington; legislators created laws that allow drunk driver Mark Mullan to be free to kill Judy and Dennis Schulte
From Sky Valley Chronicle
SEATTLE, WA) — Although he hasn’t been tried and convicted of anything yet, if you listen to the outrage on local talk radio and watch the TV news reports, Mark W. Mullan, 50, has already been convicted in the court of public opinion.
If this was the age of the American Wild West, some folks might be out looking for a tall oak tree and a sturdy rope.
“How could a guy like this, with his ongoing record of drunk driving, be out on the street and behind the wheel of a car again to kill people?”, goes the talk radio caller refrain.
“How could the system have failed society so miserably on this?”
“When will the legislature start taking drunk driving seriously and start putting these people away for a long time so they can’t kill people on the streets?”
“What’s wrong with those people down in Olympia that they just don’t get this?”
And on it goes.
People across the community are outraged that Mullan – the suspect who was arrested at the scene of an accident in Seattle this week in which a truck rammed into four members of a family, killing two outright and seriously injuring another two – was, according to court documents, a man who had a long history
of driving impaired ….MORE

FELTON — Sober and admittedly nervous in his first speech on Wednesday, Donovan Hicks Barclay III told teen drivers about the horror of two DUI crashes, one of which killed his two cousins and the other that nearly killed him.
A judge ordered Barclay, 23, to talk to students at San Lorenzo Valley High School and about five other schools in the next few months to warn them of the dangers of driving while impaired.
Barclay said he was high on marijuana during his first crash in 2007, when he slammed a Saab into a tree and killed Tyler and Shane Barclay, ages 17 and 22. Donovan, then 17, woke up in a hospital a week later with no memory of the crash.
His mother broke the news that his cousins were dead.
“It hit me really hard. I was crying for a week straight,” Donovan said during the assembly.
He paused as he looked at the crowd of stunned 11th and 12th graders.
“They were my best friends. I loved them. I feel guilty every day,” he said.
After the speech, Donovan said he was sweaty and nervous …MORE

FARMINGTON — The site of a fatal car crash Thursday evening was one the most dangerous intersections in Farmington.
Ladell Light, 37, died Thursday night after he crashed his car into a white GMC truck at the intersection of West Main Street and La Plata Highway. The crash was at 5 p.m., and Light died at San Juan Regional Medical Center three hours later.
